Passing a Bad Check (570.120)
Passing a bad check is defined as (1) making, issuing, or passing a check,
with the purpose to defraud, knokwing that it will not be paid by the
drawee, or that there is no such drawee; or (2) making, issuing, or
passing a check knowing that there are insufficient funds in the account
or that there is no such account or no drawee and fails to pay the
check within 10 days after receiving actual notice that it has not
been paid. Passing a bad check is an A misdemeanor. Passing a bad check
is raised to the level of a D felony if (1) the face amount of the
check is $150.00 or more; or (2) the issuer had no account with the
drawee or if there was no such drawee.
