Driving while intoxicated is defined as operating a motor vehicle while in an intoxicated or drugged condition. First offense DWI is a class B misdemeanor. Generally, a second offense within five years of another intoxication-related traffic offense is a class A misdemeanor. Generally, a third or subsequent offense within ten years of another intoxication-related traffic offense is a class D felony.
