Driving While Suspended / Revoked (302.321)
Driving while revoked is defined as operating a motor vehicle on a highway
when his license or driving privilege has been canceled, suspended,
or revoked under the laws of this state or any other state and acts
with criminal negligence with respect to knowledge of the fact that
his driving privilege has been canceled, suspended, or revoked. Violation
of this law is a class A misdemeanor for the first offense. DWR is
a class D felony on the second or subsequent conviction when the suspension
is alcohol-related. DWR is a class D felony on the fourth or subsequent
conviction for any other offense.
Driving privileges may be suspended
for several reasons including administrative alcohol suspensions, point
suspensions, unpaid judgment suspensions,
failure to maintain proof of financial responsibility suspensions,
and failure to appear suspensions.
